DMCA Policy

Strawberry Dole Whip respects the intellectual property rights of others and expects its users to do the same. This policy outlines the procedures for reporting alleged copyright infringement and for responding to such reports in accordance with the Digital Millennium Copyright Act (DMCA).

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Strawberry Dole Whip service, please notify our Copyright Agent as set forth in this policy. We will respond to clear notices of alleged copyright infringement that comply with the DMCA.

Filing a DMCA Notice of Alleged Infringement

To file a DMCA notice, you must send a written communication that substantially includes the following elements:

  1. Identification of the copyrighted work: A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit Strawberry Dole Whip to locate the material (e.g., URL(s)).
  3. Contact Information: Your address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  4. Statement of Good Faith Belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: A physical or electronic signature of the complaining party or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material.

DMCA Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification of the material, you may file a counter-notification with us. Your counter-notification must be a written communication that substantially includes the following elements:

  • Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL(s)).
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information: Your name, address, and telephone number.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Strawberry Dole Whip may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Physical or Electronic Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly provide the complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days, unless we receive notice from the complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system.
